Pokus síťové analýzy primárních předpisů

Abstract

Tento článek je věnován experimentální aplikaci metod síťové analýzy na český právní řád (primární předpisy) s cílem aplikovat na něj systémovou teorii práva a koncept center a periferií. Na základě dat z e-Sbírky byla vytvořena datová sada odkazů mezi předpisy, která byla převedena do síťového modelu. Článek obsahuje základní analýzu rozdělení stupňů uzlů a kvantitativní i kvalitativní analýzu izolovaných a periferních předpisů. Kvantitativní analýza délky a průměrné rychlosti novelizace jednotlivých skupin předpisů je interpretována v termínech útlumu legislativní aktivity na periferii a obsoletizace periferních předpisů. Experiment demonstruje potenciál síťové analýzy pro hlubší pochopení struktury právního řádu.

This paper is dedicated to the experimental application of network analysis to the Czech legal order (primary legislation), with the objective of employing to it the system theory of law and the concept of centers and peripheries. A dataset comprising references between laws, derived from e-Sbírka, was transformed into a network model. The paper includes a basic analysis of the degree distribution of nodes and a quantitative and qualitative analysis of isolated and peripheral laws. The quantitative analysis of the length and average amendment rate of each group of laws is interpreted in terms of the decay of legislative activity at the periphery and the obsolescence of peripheral laws. The experiment demonstrates the potential of network analysis for a deeper understanding of the structure of the Czech legal order.
